Terms of Service

These Terms of Service ("Terms") govern your access to and use of TitleScoreCard (https://titlescorecard.com), operated by Awesome Creator Academy LLC ("Company," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account

You must be at least 16 years of age to use the Service. By creating an account, you represent that you are at least 16 years old and that the information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

2. Description of Service

TitleScoreCard provides YouTube title analysis, scoring, benchmarking, and intelligence reporting services. The Service includes:

• • AI-powered title scoring across multiple dimensions (clarity, emotion, SEO, virality, etc.)
• • Benchmarking against a corpus of publicly available YouTube video metadata
• • Formula library with title structure patterns and performance data
• • Intelligence reports with data-driven insights for content strategy
• • Trend analysis and historical performance tracking

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

3. Subscription Tiers and Payments

3.1 Free Tier

The free tier provides limited access to title analysis (up to 5 analyses per day), basic formula library, and 2 free intelligence reports. No payment is required.

3.2 Pro Subscription

The Pro subscription provides expanded access including unlimited title analyses, full formula library, 10 additional intelligence reports, and advanced features. Pricing is as displayed at the time of purchase.

3.3 Individual Report Purchases

Individual intelligence reports may be purchased separately. Each purchase grants access to the report for the current month's edition. Reports are updated monthly; each monthly edition is a separate product.

3.4 Payment Terms

• • All payments are processed by Stripe, Inc. and are subject to Stripe's Services Agreement.
• • Subscriptions renew automatically at the end of each billing period unless cancelled.
• • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• • Refunds are handled on a case-by-case basis. Contact us within 7 days of purchase for refund requests.
• • Prices are in USD and may be subject to applicable taxes.

4.1 Our Intellectual Property

The Service, including its proprietary scoring methodology, algorithms, benchmarking corpus, formula library, report templates, user interface design, and all associated documentation, is the exclusive intellectual property of Awesome Creator Academy LLC. This includes but is not limited to:

• • The 7-dimension title scoring algorithm and its weighting methodology
• • The Hub/Help/Hero content classification framework as applied to title analysis
• • The curated benchmarking knowledge corpus and its statistical derivations
• • The API key rotation and pool management methodology
• • All intelligence report formats, analysis frameworks, and data visualizations
• • The formula structure library and associated performance benchmarks

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of our proprietary algorithms, unless applicable law permits it or you have our written permission.

4.2 Your Content

You retain ownership of the titles and content you submit for analysis. By submitting content to the Service, you grant us a limited, non-exclusive license to process that content for the purpose of providing the Service. We do not claim ownership of your submitted titles or use them for purposes beyond delivering your analysis results.

4.3 Report Usage

Purchased reports are licensed for your personal or internal business use only. You may not redistribute, resell, or publicly share the full content of purchased reports without our written permission. You may cite limited excerpts with attribution to TitleScoreCard.

5. User Conduct and Acceptable Use

You agree not to:

• ✕ Use the Service for any unlawful purpose or in violation of any applicable laws
• ✕ Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
• ✕ Use automated scripts, bots, or scrapers to access the Service without our written permission
• ✕ Circumvent rate limits, access controls, or other security measures
• ✕ Redistribute, resell, or sublicense access to the Service or its outputs
• ✕ Submit content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• ✕ Interfere with or disrupt the Service or servers or networks connected to the Service
• ✕ Attempt to reverse engineer, decompile, or extract the scoring algorithms or proprietary methodology

• • Title scores, recommendations, and insights are algorithmic assessments, not guarantees of performance.
• • YouTube's recommendation algorithm is proprietary and changes frequently. Our analysis reflects historical patterns, not future outcomes.
• • AI models may produce inaccurate, incomplete, or biased outputs. You should exercise independent judgment.
• • We do not guarantee that following our recommendations will result in increased views, subscribers, or revenue.
• • Our Service does not constitute professional advice (legal, financial, marketing, or otherwise).

7. Third-Party API Compliance

Our Service relies on third-party APIs. By using the Service, you also agree to comply with:

8. Data and Benchmarking

Our benchmarking corpus is built from publicly available YouTube video metadata. We do not claim ownership of YouTube content or metadata. Statistical analyses, aggregations, and insights derived from this data are our intellectual property.

Benchmark data is refreshed periodically through automated snapshots. Historical data is maintained for trend analysis. We make reasonable efforts to ensure data accuracy but do not guarantee that benchmarking data is complete, current, or error-free.

9. Report Licensing and Usage

Intelligence reports purchased through the Service are licensed, not sold. Each report purchase grants you:

• • A non-exclusive, non-transferable license to use the report for personal or internal business purposes
• • The right to download and store one copy of the report in PDF format
• • The right to cite limited excerpts with attribution to TitleScoreCard

You may NOT: redistribute the full report, resell report access, publicly post the complete report content, or use reports to build a competing service. Violation of report licensing terms may result in account termination and legal action.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the Service will be accurate or reliable; (c) the quality of any products, services, information, or other material obtained through the Service will meet your expectations; or (d) any errors in the Service will be corrected.

12. Indemnification

You agree to defend, indemnify, and hold harmless Awesome Creator Academy LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right or privacy right; or (d) any claim that your content caused damage to a third party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• • Your right to use the Service will immediately cease.
• • We may delete your account data in accordance with our data retention policy.
• • Provisions that by their nature should survive termination will survive (including IP, limitation of liability, indemnification, and dispute resolution).

You may terminate your account at any time by using the account deletion feature or contacting us. Active subscriptions must be cancelled before account deletion.

14. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Informal Resolution: Before filing any formal dispute, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Arbitration: Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English and held in Atlanta, Georgia, or remotely at the parties' mutual agreement.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. General Provisions

• • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Awesome Creator Academy LLC regarding the Service.
• • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• • Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or failures of third-party services.
• • Modifications: We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance.
